ReleaseofLiability Release of Liability Terms and Conditions Leave of Absence Travel offers retail travel services to customers, which are provided by separate and independent vendors of travel services. Leave of Absence Travel does not operate, control, or otherwise provide the services of the independent travel vendors. Hence, by submitting this form, the customer agrees that Leave of Absence Travel acts only as agent for the client in acquiring transportation, hotel accommodations, sightseeing and other privileges, or services for the clients’ benefit, and on the express condition that Leave of Absence Travel shall not be responsible for any loss, cancellations, accident, injury, delay, defect, omission or irregularity which may occur or be occasioned, whether by reason of any act, negligence or default of any company or person engaged in or responsible for carrying out any of the arrangements, or otherwise in connection therewith. I understand that participation in trip activities could involve risk of physical injury, illness, death or property loss, and despite safety precautions, Leave of Absence Travel cannot guarantee safety thereof, as all risks cannot be prevented. I understand that any medical expenses, property loss, or other personal expenditures that result during or from this trip, are to be borne by the Traveler. Leave of Absence Travel cannot be responsible for assuring the safety and reliability of private transportation or drivers, nor for any non-sponsored activities and travel that I might choose to participate in before, during or after the trip, and I therefore accept the risks and responsibilities associated with such private vehicle travel and activities. YOU VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR AND HEREBY RELEASE, WAIVE, DISCHARGE, HOLD HARMLESS, AND COVENANT NOT TO SUE COMPANY, ITS OFFICERS, MEMBERS, AGENTS, CONTRACTORS, EMPLOYEES, AND OTHER REPRESENTATIVES (each a “company party” and collectively, the “company parties”) FOR ANY AND ALL CLAIMS, DEMANDS, ACTIONS, CAUSES OF ACTION, AND/OR LOSSES (including but not limited to any exemplary, direct, indirect, incidental, special, consequential, punitive, or other damages, medical expenses, lost wages/income, loss of services, lost profits, property damage or loss, illness, death, cancellation, interruptions. weather, natural disaster, strike, job reasons, accident, sickness, evacuation, acts of war, medical conditions, baggage delay, loss, theft, and other Liabilities associated with travel and your participation in the trip.) (collectively “liabilities”) WHATSOEVER ARISING OUT OF OR IN ANY WAY RELATED TO YOUR TRAVEL TO AND/OR PARTICIPATION IN THE RETREAT AND/OR ANY ACTIVITIES CONDUCTED IN CONNECTION THEREWITH, REGARDLESS OF WHETHER SUCH LIABILITIES ARE CAUSED BY THE NEGLIGENCE OF ANY COMPANY PARTY OR OTHERWISE, AND REGARDLESS OF WHETHER SUCH LIABILITY ARISES IN TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ANY COMPANY PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LIABILITIES, TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW. You have been asked to obtain travel insurance to cover against Liabilities resulting from trip cancellation or interruptions. In consideration of the opportunity afforded, with full knowledge and acceptance of the risks associated with this trip and any recreational activities noted within; and with full understanding of the above issues/conditions and risks, I hereby release, indemnify and hold harmless Leave of Absence Travel, and any company staff members from all form and manner of risks inherent in, and from all claims, suits and demands of any nature arising from participation in said trip, or activities.
